1.Accepting the Terms

By accessing or using the Services, creating an account, or purchasing a subscription, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must discontinue use of the Services immediately.

2. Service Description

ViaCloud is a cloud-based Software-as-a-Service (SaaS) platform designed to assist businesses in managing bookings, appointments, customers, subscriptions, payments, invoicing, reporting, and related business operations.

ViaCloud reserves the right to modify, enhance, suspend, or discontinue any part of the Services at any time.

3. Account Registration

Users must provide accurate, complete, and current information during registration.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

ViaCloud reserves the right to suspend or terminate any account suspected of unauthorized, fraudulent, or unlawful activity.

4. Subscription Fees and Payments

​​

Certain Services may require payment of subscription fees.

All fees are payable in advance according to the selected subscription plan.

Unless otherwise required by applicable law, subscription fees are non-refundable after the commencement of a billing period.

ViaCloud may revise pricing and subscription plans at its discretion upon prior notice to customers.

5. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes.

• Upload, transmit, or distribute harmful or illegal content.

• Attempt to gain unauthorized access to the platform or related systems.

• Interfere with the security, integrity, or performance of the Services.

• Copy, resell, sublicense, or exploit the Services without written authorization.

6. Intellectual Property Rights

All software, trademarks, logos, designs, content, technology, and intellectual property associated with ViaCloud remain the exclusive property of ViaCloud and its licensors.

No rights or licenses are granted except as expressly stated in these Terms.

7. Customer Data

​​

Customers retain ownership of all data submitted to the Services.

You grant ViaCloud a limited right to process, store, transmit, and use such data solely for the purpose of providing, securing, maintaining, and improving the Services.

8. Service Availability

​​

ViaCloud will use commercially reasonable efforts to maintain service availability.

However, ViaCloud does not guarantee uninterrupted or error-free operation of the Services.

Temporary interruptions may occur due to maintenance, upgrades, security measures, or circumstances beyond our control.

9. Limitation of Liability

​​

To the maximum extent permitted by law, ViaCloud shall not be liable for:

• Loss of profits.

• Loss of business opportunities.

• Loss of data.

• Indirect, incidental, consequential, or special damages.

ViaCloud's total liability arising from or relating to the Services shall not exceed the subscription fees paid by the customer during the twelve (12) months preceding the event giving rise to the claim.

10. Termination

​

Customers may cancel their subscriptions at any time.

ViaCloud may suspend or terminate access to the Services if a customer violates these Terms, fails to pay applicable fees, or engages in activities that threaten the security or integrity of the platform.

11. Amendments

​​

ViaCloud may amend these Terms from time to time.

Continued use of the Services following publication of revised Terms constitutes acceptance of such revisions.

12. Governing Law

​​

These Terms shall be governed by and interpreted in accordance with the laws and regulations of the Kingdom of Saudi Arabia.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Saudi Arabia.
